The Client acknowledges that the originality, creation and authorship of Protected Information belong to the Company. The Company does not make statements or guarantee the accuracy or completeness of Protected Information, nor will it be responsible for the Customer's perception of said “Protected Information”.

 

3. Acceptable use

3.1     You must not:

 (b)    use our website in any way that is unlawful, illegal, fraudulent or harmful, or in connection with any unlawful, illegal, fraudulent or harmful purpose or activity;

3.2     Membership holders are permitted to contact the candidates registered on the portal system to discuss job opportunities. Job seekers are permitted to contact clients when applying for a job listing posted via the ‘Live Roles’ section.

3.3     However, any individual outside of this must not use data collected from our website to contact individuals, companies or other persons or entities.

3.4     You must ensure that all the information you supply to us through our website, or in relation to our website, is [true, accurate, current, complete and non-misleading].

3.5     CaptoCV Services Limited does not warrant that the website or portal service will function without error and cannot be held liable in such circumstance.

 

4. Registration and accounts for Portal Access

4.1     To be eligible for the membership displayed on our website, you must be a registered company with a registration number, VAT number and have a valid contact reference.

4.2     If you are an employer searching for candidates, you must register an account with CaptoCV Services Limited to access the CV Portal. You may be entitled to a 24-hour free trial. You must complete all details required accurately. A Username and password link will be sent to you by a member of the CaptoCV Services customer services team. ‘Free Trial’ activation links will be valid for a period of 24 hours, unless specified otherwise.

4.3     You must not allow any other person to use your account to access the portal without our consent.

4.4     You must notify us in writing immediately if you become aware of any unauthorized use of your account.

4.5     You must not use any other person's account to access the website.

5. User login details

5.1     If you register for an account with our website, we will provide you with a Username and you will be asked to create your password.

5.2     You must keep your password confidential.

5.3     You must notify us in writing immediately if you become aware of any disclosure of your password.

5.4     You are responsible for any activity on our website arising out of any failure to keep your password confidential, and may be held liable for any losses arising out of such a failure.

6. Cancellation and suspension of account

6.1     We may:

(a)     Suspend your account;

(b)     Cancel your account; and/or

(c)      Edit your account details,

          at any time, if these terms are broken, using our sole discretion. We will notify you in writing of this.

7. For Employers: Content when posting a live job on the CaptoCV Services Limited website

7.1     You warrant and represent that your content will comply with these terms and conditions.

7.2     Your content must not be illegal or unlawful, must not infringe any person's legal rights, and must not be capable of giving rise to legal action against any person (in each case in any jurisdiction and under any applicable law).

7.3     Your content, and the use of your content by us in accordance with these terms and conditions, must not:

(a)     be libellous or maliciously false;

(b)     be obscene or indecent;

(c)      infringe any copyright, moral right, database right, trade mark right, design right, right in passing off, or other intellectual property right;

(d)     infringe any right of confidence, right of privacy or right under data protection legislation;

(e)     constitute negligent advice or contain any negligent statement;

(h)     be in breach of racial or religious hatred or discrimination legislation;

(n)     be untrue, false, inaccurate or misleading;

(q)     Be offensive, deceptive, fraudulent, threatening, abusive, harassing, anti-social, menacing, hateful, discriminatory or inflammatory];

Jobs will go live onto the website once a member of CaptoCV Services Limited has checked and verified the content.

Should we find the job description includes any of the above discriminatory points, CaptoCV Services Limited have the right to refuse to post the job.

 

8. Force Majeure

8.1      In any event that is beyond the control of CaptoCV Services Limited, such as and without limitation to, a strike, fire, storm, natural disaster, flood, supply difficulty, frost, difficulties in supply, labour dispute or any dysfunction/ interruption of national or international communication channels. In all cases of force majeure, you agree that CaptoCV Services Limited is free of any liability and is therefore not liable for any damages or compensation.

8.2      CaptoCV Services Limited is also committed to doing its best to ensure the site is running smoothly, however, it cannot be prosecuted for internal malfunctions, bugs, or any other site or hosting problems. The site is designed to work with the latest versions of internet browsers. We cannot guarantee the proper use for the site through other browsers, previous versions or mobile devices of type touch tablets or phones. The Customer accepts the service as it stands.

 

9. Your Membership

9.1      You have the option to temporarily freeze your account in turn we also have the right to freeze your account for up to 1 months.

9.2       Should you wish to freeze your account; you must inform your account manager or the customer service team in writing stating the period of how long you wish the membership to be frozen.

9.3       You have the right to reverse the freeze on your account at any time by calling your account manager or the customer service team.

9.4       Frozen days will automatically shift the end date of your access.

 

10. Payments & Invoicing

10.1    All prices are exclusive of VAT.

10.2    You will receive an invoice from CaptoCV Services Limited after the service activation form has been completed, signed and returned. The settlement of payment is only by bank transfer.

10.3   Upon signing the service activation and receiving account login details, you agree to pay the invoice in full.

10.4    Payments are due on company’s receipt of invoice and you agree to pay fees on receipt of Invoice.

10.5    Payment must be cleared within 10 days

10.6    Accounts not paid within 10 days of the invoice will be placed on hold, and
CaptoCV Services Limited may terminate services.

10.7    CaptoCV Services Limited reserves the right to assess a 7% of total invoice for late payment surcharge and assign a third party to collect and receive late payments. We will also provide the assigned third party with any relevant information about the company to assist them with their duty.

10.8    Furthermore, CaptoCV Services Limited reserves the right to levy interest at 3% above BOE (for customers in the UK)/ ECB (for customers in Europe) base rate at the time of collection in the case of legal proceedings.

10.9    We accept the following currency: Euro and GBP

 

11. Breaches of these terms and conditions

11.1  Without prejudice to our other rights under these terms and conditions, if you breach these terms and conditions in any way, or if we reasonably suspect that you have breached these terms and conditions in any way, we may:

(a)     send you one or more formal warnings;

(b)     temporarily suspend your access to our website;

(c)      permanently prohibit you from accessing our website;

(d)     [block computers using your IP address from accessing our website];

 (f)     commence legal action against you, whether for breach of contract or otherwise; and/or

(g)     [Delete your account on our website].
